Family Based Green Card Petitions
Both U.S. Citizens and Lawful Permanent Residents are eligible to sponsor family members for Permanent Residency. However, U.S. Citizens are eligible to sponsor a wider group of family members than Lawful Permanent Residents.
U.S. Citizens are eligible to sponsor the following:
Immediate Relatives: Spouses, unmarried children under the age of 21, and Parents (if U.S. Citizen is 21 or older)
Unmarried Sons or Daughters 21 years of age or over
Married Sons or Daughters of any age
Siblings (if U.S. Citizen is 21 or older)
Lawful Permanent Residents are eligible to sponsor:
Spouses
Unmarried Children under the age of 21
Unmarried son or daughter who is 21 or older
Important Considerations
Both U.S. Citizens and Lawful Permanent Residents must clear certain financial hurdles to sponsor a Foreign National. Additionally, once that Foreign National is approved for Immigration, the U.S. Citizen or Lawful Permanent Resident sponsor is legally liable for the foreign national under certain circumstances.
